Welcome to Scraptalk.com! This agreement describes the legal framework in which you participate on Scraptalk.com, what your rights and responsibilities are and what you can expect from us.

By visiting this web site and participating in its services, you warrant that you will not post, private message, or e-mail through our site any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violate of any law.

You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead when registering for membership at Scraptalk.com

Content. If you post, upload, or submit content and/or material (including but not limited to reviews, posts, layouts, and comments) via our web site, you grant Scraptalk.com.com a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, and display such content in any media pertaining to Scraptalk.com. (For example, we can publish all or teaser portions of your Content online and offline.)

Copyrighted material may not be used or reproduced unless you are the bearer of the copyrights in which you grant Scraptalk.com nonexclusive, royalty-free rights for use on our site.

Bear in mind that others will have access to your posted material and layouts and might copy, modify or distribute it. By submitting to Scraptalk.com’s boards and galleries you acknowledge this fact.

Scraptalk.com takes no responsibility and assumes no liability for any content posted by you or any third party.

When submitting content to Scraptalk.com whether in the form of reviews or comments, the following are inappropriate:

Violating the intellectual property rights of a third party

Creating more than one account

Defaming a third party

Selecting a Member ID that violates someone's trademark rights

Illegal activity under the laws of California and the United States

Submitting content on a product/topic that is reasonably likely to offend a person
looking for information on that product/topic

Publishing the same review more than once.

Reviews. As a member, you can publish reviews and comments. Your reviews and statements are displayed publicly. Your member name is automatically displayed with reviews and comments you publish. You may review an item one time. Please make statements that are true and accurate. Unkind and unsubstantiated comments may be removed by Administrators.

All reviews express the views of the author and not of that of the owners of Scraptalk.com. The owners of the Scraptalk.com reserve the right (but not the obligation) to remove, edit, move or close any review for any reason, but do not regularly review posted content.

As an unregistered visitor, you may view the reviews.

Message Board Usage. Although the owners of Scraptalk.com will attempt to keep all objectionable messages off this forum, it is impossible for them to review all messages. All messages express the views of the author, and the owners of Scraptalk.com will not be held responsible for the content of any message.

The owners of Scraptalk.com have the right to remove, edit, move or close any thread for any reason. Any user who feels that a posted message is objectionable is encouraged to contact us by clicking on the "Report this post to a moderator" link located on the right hand side of each post.

Links to other web sites are allowed.

Chain letters, pyramid schemes, SPAM, and solicitations are inappropriate on this message board.

Swaps and trades are not permitted at Scraptalk.com List RAKs (Random Acts of Kindness), Round Robin RAKs and organized RAKs are not permitted.


Other guidelines for posting at Scraptalk.com:

No profanity.

Rudeness, verbal abuse/attacks (including name calling), and flaming will not be tolerated. Posts and the users who make them may be removed.

The process of cross-posting is not allowed. Cross-posting is posting the same message in several boards on Scraptalk.com.

Gallery Usage.Terms and conditions regarding posts made in the gallery include, but are not limited to, the guidelines presented above. In addition to those guidelines, the following rules apply:

The gallery exists for sharing scrapbook related images (i.e. layouts, paper-piecings, patterns, etc.). It may not be used as a personal file archive except for use in conjunction with the gallery (meaning you may not upload personal images to be housed on our server unless the images are being used in the gallery). Images may be removed by Scraptalk.com at any time.

All images are and may be viewed by the public on the Scraptalk.com website. No profane, pornographic, or otherwise deemed inappropriate material may be posted.

As a courtesy to our users, we grant you the right to delete your layouts you have uploaded at anytime. This is provided in the event that you become published and must remove your material or need to remove your material for any other reason.

Personal Information. Please do not post names, addresses, phone numbers or other personal, private or privileged information.

As with all Internet web sites, certain public information is collected through a variety of methods (cookies, server logs, online forms, etc). We do not sell, rent, lease or in any other way distribute your private information which is gathered at Scraptalk.com to third parties. Your personal information (such as e-mail addresses, username, etc) are used in-house by the owners in order to contact you in the event of personal communication, contests, announcements, newsletters, and other communication needed to interact with the users of our web site. This information is not used for any other reason. Understand that some of the information you provide in your profile (such as location, birth date, etc.) is visible to the public in your profile.

Advertisements sent to you via our in-house advertisement system and/or newsletters are approved by Scraptalk.com and are to be expected while visiting our site. Advertisers are not granted access to your personal information.

Suspension of posting privileges. Repeated and/or serious violations of our guidelines, attacks (whether by posting or e-mail) on any Scraphead, or community disruption of any sort may result in the suspension of posting privileges. The decision to suspend privileges can be made only by the site owners. Regardless of the reasons, once posting privileges are suspended, no further posts will be permitted regardless of content or intent.

Indemnity. By choosing to use Scraptalk.com, you agree to indemnify Scraptalk.com, its officers, agents, partners, and employees from any and all claims or damage, including reasonable attorney's fees, made by third parties due to, or arising out of content you choose to submit, post or transmit through Scraptalk.com; or if your use of or connection to Scraptalk.com; your violation of the User Agreement; or, your violation of any rights of another.

Violations of the rules contained herein can result in legal action. The owners also reserve the right to reveal a users identity (or whatever information we know about the user) in the event of a complaint or legal action arising from any material posted by the user. This release would be granted pending an official, legally binding request.
